On 8th September, 2024, our Founder and Managing Counsel, Francisca Serwaa Boateng launched a new book titled “The Handbook on Civil Jurisdiction of Court of Appeal & Supreme Court.
The
essence of this book – THE HANDBOOK ON CIVIL JURISDICTION OF COURT OF APPEAL
& SUPREME COURT – is to fill the void in the literature on the subject. The
book takes the subject of civil procedure rules and practice of the appellate courts
to new and greater heights, dealing with and discussing the Supreme Court
Rules, 1996 (C.I. 16) (as amended) and the Court of Appeal Rules, 1997 (C.I.
19) (as amended) in depth. Part A deals with the rules of procedure and
practice for civil appeals in the Court of Appeal. Part B deals with the rules
of procedure and practice for civil appeals in the Supreme Court as well as the
general jurisdiction such as original, reference, supervisory, review and
Presidential election challenge jurisdiction.
Apart from rendering the rules in
conversational language – as against the often highly technical, verbose and
tedious draftsman’s language used in constitutional instruments such as C.I. 16
and C.I. 19 – the various decisions the appellate courts have given regarding
the meaning, interpretation and application of the rules are discussed in
detail. As it is characteristic of the author – to engender discussion and
debate about the rules and decided cases – she gives her comments on aspects of
the rules and the way the appellate courts have applied them. This book also comes complete with precedents.
The precedents are based on C.I. 16 and C.I. 19 (as amended) as well as the
Civil Forms in both C.I. 16 and C.I. 19 and the various practice directions
given by the Supreme Court from time to time.
In effect, this book, just like its worthy
predecessor – THE
HANDBOOK ON CIVIL PROCEDURE & PRACTICE IN GHANA
– is an invaluable addition to every lawyer, judge and law student’s library.
Both books move together like the metaphoric two peas in a pod. Thus, they must
be owned and used together to give the owner the complete satisfaction of
having their entire civil procedure and practice materials from the trial courts
to the highest court in two books. Talk about convenience brewed in two simple
packs!
On 17th April, 2024, Gloria Yayra Agbokey joined Team FSB as an Administrative Assistant and Personal Assistant to our Managing Counsel.
On 1st March, 2024, Angelica joined the firm as an Intern/Research Assistant for a period of six weeks. Angelica is a level 300 student at the University of Ghana School of Law, she is an outgoing and a friendly young lady.
Felicity Ewurasi Boadi joins us as the Office Manager. She is a purpose driven young lady who is passionate about Information Technology, exploring new places and enjoying nature and outdoor adventures.
On 1st September, 2023, our Founder and Managing Counsel, Francisca Serwaa Boateng launched a new book titled “The Handbook on Civil Procedure & Practice in Ghana.”
This book is an indispensable and worthy companion. It is a single-source textbook that discusses everything the lawyer, judge, law student and lay client needs to know about the steps and procedure in civil litigation in the Circuit and High Courts. It is written in easy and clear language, follows a simple chronology and it is practice-oriented to aid the active practitioner as well as the in-house Counsel. The author provides the reader with a simplified rendition of the court rules and decisions from leading cases, as well as reference sources for further reading. She also provides several relevant precedents to serve as practical guide for drafting court documents.
The important themes of the book analyze how a case is filed in court up to the application for directions stage, where the case is ready for trial (including the use of ADR methods in resolving cases); the procedure from trial up to judgment; and the processes for executing court judgments. The different applications parties may file in a case are discussed, as well as various procedure for filing specific cases such as defamation, enforcement of human rights, maritime actions, enforcement of foreign judgments and arbitral awards, and so forth. Appeals are discussed and so are applications for judicial review.
To keep the information in the book up to date and fresh, new materials on cases, laws and rules will be posted periodically on the author’s website, www.fsboateng.com.
The Team at FSB Law Consult was at Central University, Miotso Campus on Tuesday, 24th May, 2022 to participate in the school’s 3rd Industry Day Fair following an invitation from the school. We had the priviledge to introduce our firm to the students and advice them on the legal sector and also give them pointers for their career.
Aside our firm, there were many other companies from various industries present. It was a great experience interacting with the students, the staff of the school as well as the other companies present.

On 21st July, 2021, the High Court (Labour Division), Accra awarded damages of GH₵75,000 for breach of right to privacy in favour of Ms. Q-C, a former school Administrator. The proprietress of the school where Ms. Q-C formerly worked, had taken her photo without her consent, knowledge or authorization and shared the photo on the school’s WhatsApp group for its teaching and non-teaching staff.
The photo was taken when Ms. Q-C and another staff member, Mr. K A (now deceased) were taken by two policemen from the school premises to the Manet Police Station at Spintex Road, Accra. From the evidence, the policemen acted upon the instruction and direction of the school proprietress. Ms. Q-C was never charged with or convicted of any crime at all. But her photo taken at the Police Station and circulated by the school proprietress put no one in doubt that she had committed a crime.
The Court held that, taking the photo without her consent, knowledge or authorization while in the custody of the police and circulating it on the school’s staff WhatsApp group was an infringement on Ms. Q-C’s right to privacy as enshrined in the Constitution and the Data Protection Act. The Court further awarded her damages for false imprisonment, defamation and constructive dismissal.
Moral of the case: We must be careful what information we pick on others and share on social media or elsewhere. We may suffer huge damages and costs for it.
The Accra High Court has ordered the government to stop collecting the personal data of mobile phone subscribers.
In a 70-page landmark judgment delivered in Accra today (July 22, 2021), the court held that the President’s actions violate and continue to violate the right to privacy.
The court, presided over by Mrs Justice Rebecca Sittie, also directed the government to delete all such data and submit a report to the Registrar of the High Court within 14 days.
The court ordered Vodafone, the NCA and Kelni GVG to pay damages of GH¢ 20,000 each to the applicant.
The Case
It may be recalled that on April 6, 2020, Mr Francis Kwarteng Arthur, a private legal practitioner, went to the High Court to challenge the President’s order contained in Executive Instrument (EI) Number 63 as well as the manner in which the order was being implemented. EI 63 orders all telecommunication network and service providers to handover the personal information of all customers and subscribers to the President.
The President’s reason for making CI 63, according to the Attorney-General, was to conduct contact-tracing to control the spread of the deadly covid-19.
Since the passing of the EI 63 in March 2020, the personal information of millions of mobile phone service subscribers has been collected and given to a private company, Kelni GVG.
Counsel for the applicant, Dr Justice Srem-Sai, argued, among others, that “EI 63 offends the permissible limitation clause of the Constitution … and that the mechanism that EI 63 deploys is extremely disproportionate to the intended purpose.”
The defendants in the case are the Attorney-General, the National Communication Authority (NCA), Vodafone Ghana, MTN Ghana and Kelni GVG.
